TERMS AND CONDITIONS
1. Agreement to Terms
1.1. These Terms and Conditions constitute
a legally binding agreement made between you, whether personally or on behalf
of an entity (you), and SEARWOY, concerning your access to and use of the SEARWOY.
If you do not agree with all of these Terms and Conditions, then you are
prohibited from using the application.
1.2. We may make changes to these Terms
and Conditions at any time. The updated version of these Terms and Conditions
will be indicated by an updated Revised date and the updated version will be
effective as soon as it is accessible. You are responsible for reviewing these
Terms and Conditions to stay informed of updates. Your continued use of the
application represents that you have accepted such changes.
1.3. By accepting these Terms and
Conditions, you acknowledge that your use of the App or other services is
solely at your risk and subject and subject to all laws and that we don’t have
the responsibility in this matter.
2. Acceptable Use
2.1. Users may not access or use the
application for any purpose other than that for which we provide the
application and our services. The application may not be utilized in connection
with any commercial effort unless expressly sponsored or permitted by us.
2.2. As a user of this application, you
agree not to:
- Retrieve data or other content
from the application in a systematic manner to a built database or
directory;
- Make any illegal use of the
application, such as gathering user usernames and/or email addresses to
send unsolicited emails or creating user accounts under false pretences;
- Use the application to
advertise or sell goods and services;
- Avoid, deactivate, or otherwise
interfere with the application's security mechanisms, such as those that
prevent or restrict the use or copying of any material or impose usage
restrictions;
- Engage in unauthorized framing
of or linking to the application;
- Trick, deceive, or mislead us
and other users, especially if you're trying to learn critical account
information like user passwords;
- Make improper use of our
support services, or submit false reports of abuse or misconduct;
- Participate in any automated
system use, such as utilizing scripts to send comments or messages, or
employing data mining, robots, or similar data collection and extraction
tools.
- Interfere with, disrupt, or
impose an unreasonable load on the application or the networks and
services to which it is linked.
- Attempt to impersonate another
user or person, or use the username of another user
- Use any information obtained
from the application in order to harass, abuse, or harm another person
- Use the application or our
material in an attempt to compete with us or to establish a
revenue-generating venture or commercial operation.
- Decipher, decompile,
disassemble, or reverse engineer any of the components of or forming a
part of the application.
- Attempt to access any portions
of the application that you are restricted from accessing
- Harass, annoy, intimidate, or
threaten any of our employees, agents, or other users
- Delete the copyright or other
proprietary rights notice from any of the content
- Upload or send (or attempt to
upload or transmit) viruses, Trojan horses, or other anything that
disrupts any party's continuous use and enjoyment of the application, or
any material that operates as a passive or active information gathering or
transmission mechanism.
- Use, launch, or participate in
any automated system usage, such as using scripts to submit comments or
messages, robots, scrapers, offline readers, or similar data collecting
and extraction.
- Disparage, tarnish, or
otherwise harm, in our opinion, us and/or the application
- Use the application in a manner
inconsistent with any applicable laws or regulations
- Misrepresent experience,
skills, or information about a User
- Advertise products or services
not intended by us
- Threaten users with negative
feedback or offering services solely to give positive feedback to users
- Falsely imply a relationship
with us or another company with whom you do not have a relationship
3. Information you provide to us
3.1. You represent and warrant that:
All registration information you provide must be true, accurate, current,
and complete, and must pertain to you and not a third party.
- You will keep your password
private and will be held accountable for any and all uses of your password
and account.
- You have the legal capacity to
agree to these Terms and Conditions, and you are not a minor in the
jurisdiction in which you reside, or you have parental consent to use the
application if you are a minor.
3.2. If you know or think that someone
else knows your user information (such as an identifying code or user name)
and/or password, please alert us immediately at 2marcin56@gmail.com.
3.3. We may suspend or delete your account
if you supply false, incorrect, out-of-date, or incomplete information. If we
think that a user name you choose is incorrect, we may remove or alter it.
3.4. As part of the application's features
and functions, you may link your account to online accounts you may have with
third-party service providers (each such account, a Third Party Account) by
either:
a. providing your
Third-Party Account login information through the application; or
b. allowing us to access
your Third-Party Account, as authorised by the applicable terms and conditions
that govern your use.
4. The content you provide to us
4.1. You may be able to contribute content
to the application or provide feedback to us (User Content). You realize and
agree that other users on the application may read your User Content and may be
able to see who posted such User Content.
4.2. We have the right to remove any User
Content you put on the application if, in our opinion, such User Content does
not comply with the Acceptable Use Policy.
4.3. We are not liable and assume no
liability for any User Content, including any that contains erroneous
information or is defamatory, or for any loss of User Content.
5. Our content
5.1. Unless otherwise specified, the
application and Services, comprising source code, databases, functionality, web
application designs, audio, video, text, pictures, and graphics (Our Content),
are owned or licensed by us and are protected by copyright and trademark laws.
5.2. Unless expressly stated otherwise in
these Terms and Conditions, no part of the application, Services, or Our
Content may be copied, reproduced, aggregated, republished, uploaded, posted,
publicly displayed, encoded, translated, transmitted, distributed, sold,
licensed, or otherwise exploited for any commercial purpose without our express
prior written permission.
5.3. You are granted a limited license to
access and use the application and Our Content, as well as to download or print
a copy of any portion of the Content to which you have properly gained access,
exclusively for your personal, non-commercial use.
5.4. We will:
a. prepare the application
and Our Content with reasonable skill and care, and
b. apply industry-standard
virus detection to attempt to upload virus-infected content to the application.
5.5. The application's content is offered
solely for general information purposes. It is not meant to be advice on which
you should depend. Before acting or abstaining from acting on the basis of the
application's content, you must seek professional or specialist advice.
5.6. Although we make reasonable attempts
to update the material on our application, we make no express or implied
representations, warranties, or guarantees that Our Content on the application
is accurate, comprehensive, or up to date.
6. Application Management
6.1. We reserve the right at our sole
discretion, to:
- Monitor the application for
breaches of these Terms and Conditions;
- Take appropriate legal action
against anyone in breach of applicable laws or these Terms and Conditions;
- Refuse, restrict access to or
availability of, or disable (to the extent technologically feasible) any
of your Contributions;
- Remove from the application or
otherwise disable all files and content that are excessive in size or are
in any way a burden to our systems; and
- Otherwise, manage the
application in a manner designed to protect our rights and property and to
facilitate the proper functioning of the application and Services.
6.2. You must configure your information
technology, computer programs, and platform to access the application, and you
must use your own virus protection.
7. Modifications to and availability of
the application
7.1. We reserve the right, at our sole
discretion, to edit, modify, or eliminate the contents of the application at
any time and for any reason. We also retain the right, at any time, to change
or discontinue all or part of the Services without notice.
7.2. We cannot promise that the
application and Services will always be available. We may encounter hardware or
other issues, or we may need to undertake application maintenance, which may
result in interruptions, delays, or errors. You agree that we will have no
liability for any loss, damage, or inconvenience resulting from your inability
to access or use the application or Services during any outage or
discontinuance of the application or Services. We are under no obligation to
maintain and support the application or Services, or to provide any
corrections, updates, or releases.
8. Disclaimer/Limitation of Liability
8.1. The application and Services are
provided "as is" and "as available." Except as clearly
stated in these Terms and Conditions, you acknowledge that your use of the
application and/or Services is entirely at your own risk. To the fullest extent
permitted by applicable law, all express or implied warranties, terms,
conditions, and undertakings (including by statute, custom or usage, a course of
dealing, or common law) in connection with the application and Services and
your use thereof, including, without limitation, the implied warranties of
satisfactory quality, fitness for a particular purpose, and non-infringement,
are excluded.
8.2. We make no guarantees or assurances
concerning the application's content's accuracy or completeness, and we are not
liable for any (1) errors or omissions in content: (2) any unauthorized access
to or use of our servers, including any and all personal information and/or
financial information stored on our servers; (3) any interruption or cessation
of transmission to or from the application or services; and/or (4) any bugs,
viruses, Trojan horses, or the like transmitted to or through the application
by any third party. We will not be liable for any delay or failure to perform
our obligations under these Terms and Conditions if the delay or failure is
caused by an incident beyond our reasonable control.
9. Term and Termination
9.1. These Terms and Conditions will apply
while you use the application or Services or are otherwise a user of the
application, as applicable. You can cancel your use or participation at any
time and for any reason by following the guidelines for cancelling user
accounts in your account settings.
9.2. Without restricting any other
provision of these Terms and Conditions, we reserve the right, in our sole
discretion and without notice or liability, to deny access to and use of the
application and the Services (including blocking specific IP addresses) to any
person for any reason, including, without limitation, breach of any
representation, warranty, or covenant contained in these Terms and Conditions.
If we ascertain, in our sole discretion, that your use of the
application/Services violates these Terms and Conditions or any applicable law
or regulation, we may terminate your use of or participation in the application
and the Services, or delete your profile and any content or information that
you posted, at any time and without notice.
9.3. If we terminate or suspend your
account for any of the reasons listed in this Section 9, you are barred from
registering and creating a new account in your name, a fictitious or borrowed
identity, or the name of any third party, even if you are acting on their
behalf. We reserve the right to take necessary legal action, including without
limitation seeking civil, criminal, and injunctive remedy, in addition to
cancelling or suspending your account.
